RENTAL TERMS AND CONDITIONS

1. Definitions. “Agreement” refers to all terms and conditions contained in this document. “You” and “your” refer to the person identified as the renter, any person signing this Agreement, any Authorized Driver, and any individual or entity to whom charges are billed at the renter’s direction. All individuals defined as “you” or “your” are jointly and severally bound by this Agreement. “We”, “our”, or “us” refers to Stoppie d.o.o., and any authorized agent or representative of Stoppie d.o.o. acting under a service agreement. “Authorized Driver” includes the renter and any additional person listed in this Agreement who possesses a valid motorcycle license and is at least 25 years old, unless otherwise stated. “Vehicle” means the motorcycle assigned in this Agreement or any replacement provided, including all tires, tools, accessories, equipment, keys, and documents. “CDW” means Collision Damage Waiver.

2. Vehicle ownership. The Vehicles provided under this Agreement may be either the property of Stoppie d.o.o. or operated under leasing or management agreements with third-party owners. Regardless of ownership, Stoppie d.o.o. is authorized to manage the rental, collect fees, and act on behalf of the vehicle owner in all matters related to this Agreement. By entering into this Agreement, you acknowledge that your responsibilities—including those related to care, damage, theft, or misuse—apply equally to all Vehicles, whether owned or leased. Any breach of contract, damage, or loss may result in claims or legal action pursued by Stoppie d.o.o. and/or the legal owner of the Vehicle.

3. Rental, Indemnity, and Warranties. This is a contract for the temporary rental of the Vehicle. Each vehicle is equipped with a GPS tracker used for safety purposes and emergency response. The device records location and speed data, which may be shared with authorities in the event of an accident. If the GPS signal is not received for over two hours, the vehicle will be considered stolen and reported to the police. You will be liable for theft under these circumstances. We reserve the right to repossess the vehicle at your expense and without notice if it is used unlawfully or in breach of this Agreement. You agree to indemnify and hold us harmless from any claims, damages, or legal costs resulting from your use of the Vehicle.
You may not operate the Vehicle under the influence of alcohol, narcotics, or medications that impair your ability to ride safely. You must not allow any other person to use the Vehicle unless they are listed in this Agreement as an Authorized Driver. Loading the motorcycle or luggage compartments must not exceed the manufacturer's specified limits. You confirm that you received the Vehicle in safe, ride-ready condition.
You must present a valid international motorcycle license with the appropriate category and have experience operating motorcycles of a similar type. We may refuse rental if we believe your experience is insufficient. You will be fully liable for any damages, including total loss, if you have provided false or misleading information.

4. Vehicle Use and Travel Restrictions. You agree to operate the Vehicle in full compliance with traffic laws and regulations in the country or countries where you travel. You must observe all speed limits and avoid driving in off-road areas or locations deemed unsuitable for this type of motorcycle. Use only the fuel type recommended by the manufacturer. You will be financially responsible for any damage caused by incorrect fueling. Taking the Vehicle outside of Montenegro is strictly prohibited unless you receive our prior written consent. Unauthorized international travel constitutes a serious breach of this Agreement and may result in the vehicle being reported as stolen. We reserve the right to share your information with law enforcement, border authorities, and your country’s embassy or consulate. You acknowledge that operating the motorcycle in hazardous weather conditions, such as heavy rain, strong winds, or poor visibility, increases the risk of accidents. Damage caused in such conditions may not be covered by insurance. Use of the Vehicle under these circumstances is at your own risk.

5. Condition and Return of Vehicle. You must return the Vehicle to the specified location on the agreed date and time, in the same condition as received, accounting for ordinary wear. Any servicing or replacement of parts during the rental period requires our prior written approval. You are responsible for checking and maintaining all fluid levels. If you cannot return the Vehicle on time, you must notify us at least four (4) hours in advance. Delays may be subject to an additional charge of 50% of the daily rental rate per day.

6. Responsibility for Vehicle Damage or Loss; Reporting to Police. You are responsible for physical or mechanical damage to the Vehicle (excluding ordinary wear), including: (a) damage from collisions, up to the full market value; (b) damage or theft due to negligence or lack of ordinary care; (c) vandalism in connection with theft for which you are responsible; (d) vandalism not connected to theft; (e) charges for towing, storage, and impound fees; and (f) administrative fees related to appraisals, repairs, or replacements. All accidents, thefts, and vandalism must be reported to us and the police immediately, with supporting photos and written documentation. Do not attempt to repair the motorcycle yourself. In the event of an accident, you must follow applicable local laws.

7. Collision Damage Waiver (CDW). If you purchase CDW, we waive our right to collect costs for damages. CDW does not apply if: - fraudulent or false information was provided; - the Vehicle was operated recklessly, under the influence, or outside approved areas; - the Vehicle was used for towing, commercial use, contests, or illegal purposes; - the Vehicle was driven by an unauthorized person.

8. Insurance. The Vehicle includes third-party liability insurance in accordance with Montenegrin law or the law of any approved foreign country. Optional CDW or full coverage insurance can be purchased separately, and conditions may vary depending on the Vehicle model.

9. Charges. You agree to pay, upon demand: (a) all fines, tolls, penalties, and associated legal or recovery costs, unless caused by our error; (b) €50 if the Vehicle is returned elsewhere, plus €5 per km from the agreed return location, and recovery costs; (c) €35 if the Vehicle is not returned with a full tank unless specified otherwise; (d) €500 penalty for lost keys or documents, plus actual replacement and labor costs; (e) all legal, administrative, and collection fees; (f) Damage charges: - 100% of part cost if unusable; - 50–70% if functional but cosmetically damaged; - 25–50% for added wear on pre-damaged parts. Supporting photos and estimates will be provided. An admin fee may apply.

10. Deposit. We may use your deposit to cover any costs owed under this Agreement. The deposit may be held for up to 15 days after the rental ends for damage assessment. The deposit is not a limit of your liability unless you purchased limited liability protection. If repair costs exceed the deposit, you will be invoiced the difference.

11. Your Property. We are not responsible for loss or damage to personal belongings left in or on the Vehicle, in service vehicles, or in our office—regardless of negligence.

12. Breach of Agreement. Any violations listed in Section 5 constitute a breach of contract. You waive any right to dispute legal action or police reporting that may result.

13. Modifications. No modifications to this Agreement are valid unless documented in writing and signed by both parties. Rental extensions require vehicle inspection and written approval.

14. Protective Gear. You must wear a helmet and appropriate protective gear while operating the motorcycle. Our insurance does not cover injuries to you. You agree to ride responsibly, within the law, and avoid participating in races, demonstrations, or illegal events.

15. Miscellaneous. Our waiver of any specific breach does not constitute a waiver of future breaches. Acceptance of payment does not waive our rights. If any part of this Agreement is deemed unenforceable, the remainder remains valid.

16. Legal Jurisdiction. You agree that any legal action must be filed in Montenegro, and that Montenegrin law governs this Agreement, without regard to conflict of law rules. If any part of this Agreement is found void, the remainder shall still be enforceable.

Booking & Payments

  • A 25% deposit is required at the time of booking and is paid securely online via credit or debit card.

  • No discounts are applied unless specifically stated.

  • All payments are processed in Euros (€). We are not responsible for currency conversion fees or foreign transaction charges applied by your bank or card issuer.

  • We accept VISA, MasterCard, and AMEX cards. All payments are securely handled via WSPay.

  • If a refund is issued, any bank or processing fees will be deducted from the refunded amount.

Cancellation policy

Motorcycle Rentals

  • Free cancellation if cancelled 30 days or more before the rental start date.

  • Cancellations made 15–29 days before the start date will incur a 50% charge of the total rental amount.

  • Cancellations made 14 days or less before the start date, or in case of no-show, are non-refundable.

  • Early returns are not eligible for a refund.

Self-Guided Tours

  • Free cancellation if cancelled 60 days or more before the tour start date.

  • If cancelled 30–59 days before, we retain the deposit (typically 15% of the tour price).

  • Cancellations made less than 30 days before the tour start date, or in case of no-show, are non-refundable.

  • Hotel bookings are subject to the cancellation policy of each hotel and may be partially or non-refundable regardless of tour cancellation timing.

Modifications

  • Date changes are possible depending on availability and must be requested at least 21 days in advance.

  • In the case of force majeure (such as flight cancellations, illness, or border closures), we will do our best to offer credit or a rescheduled date.
